  • Wrongful termination due to Gross Misconduct

    Hi

    I need some help and advice in regards to my case.

    I have worked for this company for 6 and a half years and been dismissed last year in Sep-19 due to false charges of Gross misconduct. This was really tragic as I have worked very hard for this organisation and they are using these tactics to get rid of me.


    The case went through an internal disciplinary process which, The allegations brought forward were:

    1. Mileage claim against company expense policy - (This was in accordance with the agreed employment contract but both parties have lost the contract, I have other evidence to back this these claims are valid).

    2. Claiming double mileage - (I claimed mileage based on training provided by the company when I joined initially in 2012 by my manager at the time, they are denying without any evidence even though various managers have authorized these claims over the period of 3 years).

    3.Claimed business mileage when not on-site - (They have made up the false allegation of claiming mileage when I did travel to HQ site, I have evidence to back up my claims).


    I am now looking for an ET solicitor as the case is gone to ET court and have a date at the end of this month, Can you please advice how can approach forward with this case?

        So up to this point you have been representing yourself? Is the date for a preliminary hearing or the main hearing?

        I assume you have gone through the process of exchanging documents, preparing your witness statement etc. Have you reviewed the documentation from the respondent and started to prepare your case for hearing or is that why you now want solicitor involvement?

        You can pop across to our sister site*https://justbeagle.com/*and search for a solicitor that can assist with your employment tribunal hearing but i suggest you do that quickly as they will need time to review all the documentation and prepare for the hearing and they will not have much time to do this given the timescale.*

          Yes, for the company internal meetings and appeals I have been representing myself so far but need a solicitor going forward. The date is for a preliminary hearing but I have requested extension which is been postpone for now. waiting for a new date to be confirmed.


          Nothing is been exchanged yet which is why I need a solicitor to move to the next stage. Yes, I have reviewed the documentation from the respondent and they are denying on all points counter-evidence I produced in previous internal meetings.


          Thanks for the suggestion, I am going to look for an Employment solicitor now and discuss this forward.
