  • Company taking money back

    Simply put i would like some guidance as to whether the agency can take back this money on behalf of the company who have decided they now want it back ?

    You have not given the details of what exactly they are trying to claim back and why. Depending on what they are trying to recover then it may be valid if it is covered under by the Declaration Agreement in which you have agreed that, if you do not return to an assignment with Lander then any monies that are owed to you by the agency can be recovered.**

      I did return to my assignment on May 4th , after 5 weeks, they then said that we would get furlough money from the government, stopped the sixth payment of 100 pounds and told us we would not get the bonus. and they want all the money they gave us back

        The implication seems to be in the main letter that the £100 per week was given by the company you were working for in the event that furlough would not be applicable as an agency worker. Since it subsequently was then furlough took the place of the requirement to pay the £100 per week. However the bonus payment seems to be determined upon you returning to work at the company. Since you returned to work for the same company I am not sure that should be part of any requirement to repay monies back. However the Declaration Agreement is not very well worded in my opinion.*
