  • suspension time and dicplinary meeting dates

hi. I'm currently entering my fourth week of suspension from work whilst under investigation of having a patients personal belongings without permission to which I dispute.
I received a disciplinary letter on the 14/05/2020 that was written on the 11/05/2020 to attend a meeting but dated for the 14/03/2020. seeing as this was close to the weekend I intended to contact work the following Monday but another letter arrived on 18/05/2020 with the same written date but crossed out in biro and adjusted with pen. this gave me a meeting date of 18/03/2020 again I cannot attend a date 2 months in the past nor could I of attended if dated for the current month as it arrived after the time scheduled. Is this grounds for reasonable termination of the investigation due to time scale and being at fault on their part, I have not yet responded to work as im seeking advice as I think this is unfair, also I was banned form contacting any colleagues but it was not a bullying or harassment and I feel I could of gotten support form the staff in on the day I was accused. I feel this is a small part of a larger plan to terminate me form work due to illness I have and I am also payed less than my colleagues with no explanation given despite asking admin on several occasions. my illness is covered by the disability act so time off for treatment on medication should not count towards me being denied the same rate as my colleagues.

I would suggest that you do in fact contact your employer and ask them about their recent correspondence which on both occasions has been very confusing in terms of the dates.

Can i just check that in the letter asking you to attend a disciplinary hearing they provided the details of the allegations, copies of all the documentary evidence they are going to rely on at the hearing, details of the potential outcome, if disciplinary action was to be taken and giving you the right to be accompanied. Just checking they have got that all correct.

In terms of a suspension it is normal practice that you would not be able to contact work colleagues. Are you suggesting that there are work colleagues that would be able to provide witness statements to support your defence? If so then you need to let the company know and request that they should be asked to provide witness statements.

Whilst you have been on suspension to you know if they have interviewed or asked for witness statements from any of your colleagues?
If you would like a one-to-one expert consultation with me on your employment issue than I can be contacted by emailing admin@legalbeaglesgroup.com

I do not provide advice by PM although I may on occasion ask you to send me documents this way but any related advice will be provided back on your thread.

I do my best to provide good practical advice, however I do so without liability.
If you have any doubts then do please seek professional legal advice.
