  • Unfair Dismissal for Gross Misconduct

    I believe I am going to lose my job tomorrow for allegations of gross misconduct.
    I have been accused of bringing cannabis into the workplace and placing it in a colleague's bag during working hours. I placed a pouch of tobacco in his bag, which he was unaware of as he was on the phone at the time (I work in a call centre).* My employer is basing this on the fact I had exchanged money earlier in the day with said colleague and that we have admitted to discussing purchasing cannabis earlier in the day so he thought that is what* I put in his bag.I have not been presented with any evidence that cannabis was found in the bag or any proof that I have put it there beyond a statement from my colleague where he said he believes that's what it was. Will this be enough to warrant an instant dismissal?

    So I have lost my job as suspected. The reasons given to me were that we admitted discussing cannabis inside work and my colleagues facial expression when he has been asked about it being in his bag. I asked why the bag has not been searched and was told that this was due to my colleague admitting that is what it was. However I have minutes from the previous meeting that clearly state that is what he believed it was but no attempt was made to confirm it. Can someone please advise me on this?

      How long have you been employed at the company?

      You should get correspondence from the company confirming the outcome of the disciplinary and you should be given the right to appeal the decision.
