  • Hello everyone, a bit of help on an agreement for Furlough Leave

    Firstly say hello to everyone and hope that you all are fine and safe at these hard times.
    I have been working in a Hotel company for almost 5 years already and due to the Coronavirus situation, the brand is going to apply for the Gov. scheme to cover 80% of our salary. So I and my colleagues have received a letter which should be signed to get the help, however, me signing this letter, I think, I am would be in the agreement to be laid off, whenever the company likes without even Redundancy, and in the case that the Company doesn't rid me off, my contract would be permanently modified. Please have a check and tell me if I am wrong.

    The reason why you are receiving this contract variation is that furlough, which is a new term in our employment law dictionary, and to put someone onto 80% of their salary is a variation to your contract that needs to be agreed with you.

    In your current contract do you have a clause that relates to lay-off?

      About lay-off, this is what my contract says*

        Thanks for the information. There is nothing in what you have posted up which relates to lay-off so if there is nothing elsewhere in your existing contract then it would appear that clause 6 of the new document is a further variation to your contract.

        On the one hand it is good that your employer is formally dealing with the variation to your contract that being put on furlough, in the current situation, brings about, so a positive for them on this. However it does seems that they are trying to bring in clause 6 as another variation which is outside of the furlough situation which would allow for short time working or lay-off.

        You could go back to your employer and state that you are prepared to sign the contract based in the variation brought about by furlough but not in relation to clause 6 and see what they say.
