  • ET1 Tribunal Form

    Good Morning,

    After an unsuccessful attempt at an ACAS resolution with my previous employer I am now in the position that I will need to go to tribunal.

    The issue is unpaid salary, holiday pay and withheld commissions totalling almost £9k, they offered less than £1k in resolution.

    Just wanted some guidance on filling the ET1, what information should I include, should it be short and concise or do I need to go into full details?

    Tried to research online but seems very difficult to find good or consistent examples and clear guidance on what to include and what not to.

    I still have friends at my old job (Car sales- independent garage) and one of my ex-colleagues has mentioned that my old boss has been making comments about this.

    Generally saying I won't follow it through, its a long complicated process and easy to make mistakes and he will get it thrown out if I do.

    That has made me a little more anxious, don't want to make any mistakes and can't afford a solicitor.

    Hi, I know it can seem a daunting prospect but there is a lot of advice that you can get here to help you through the process.

    Firstly, are you sure that contractually the payments were due? I know this seems an obvious statement to make but sometime employees do get tripped up by well worded clauses in their contracts.

    On the ET1 you need to put in as much detail as you can about the claim but also make sure that you do not provide lots of irrelevant information. The ET1 form is important as it allows you to tell the tribunal why you believe you have a valid claim and is the first thing they will see about your case. So this is your opportunity to prove that you have a case against your former employer.

    You should have a structured narrative of what has happened, which is best done in chronological order so that the tribunal can establish exactly what has happened. This will be the first that the Tribunal will learn about your claim so write your claim in a clear way that will ensure that someone who has no knowledge of the situation can get a good understanding of the issue/s in dispute.
