  • Redundancy help

    Hi all,

    Hoping someone can help me.

Yesterday i found out I will be being made redundant.

When i first started for the company in 2010, the redundancy policy was 4 weeks to every year worked. In may 2015, this was changed to 2 weeks for every year.

My question is, am i entitled to four weeks for every year as that was the stance when i started or would it be based on the current two weeks or half and half?

Additionally, for the first three years i was full time and for the last 7 years i was part time. Would it be taken into consideration that i was full time?

Redundancy is not mentioned in my contract.

    Thank you so much,
    kind regards

So effectively the company has an enhanced redundancy payment calculation? Does the company have a redundancy policy and if does is there a clause about the company having the discretion to amend the policy?

If the redundancy policy is not contractual then in my view you will be entitled to the terms of the current document so therefore the 2 weeks. Redundancy pay is normally calculated on your current weekly salary so will be based on your part-time salary. I presume as this is an enhanced package this is not capped at the statutory weekly rate.
