my daughter has worked for a legal firm for over 22 yrs as a typist and recently has been asked to complete a declaration questionnaire ...as result she has been selected at random for credit check to find out if she has any adverse credit history / convictions and the likes of for which they will then apparently review later when it’s done ... my question is all though she has nothing to hide other than 2 defaults from over 5 yrs ago for which she missed a couple of payments but the went into payment arrangement* thereafter ( informal not IVA).
she is worried that they may try and use this adverse credit as described as it were against her and then construe her dismissal as result ....question is this lawful after 20 yrs employment ?*
And although they announced this a their policy ( which has only existed this year) she has not given written permission and the have not sought it either other than the questionnaire and the policy document they put out blanket style which all employees completed.
Question then is can she decline this or would it make matters worse and ultimately dismiss her because of none compliance.
If she does go ahead* can they use it against her and dismiss her because of the defaults on her file?
