    Hi all,

    First time using the site.



    Long story short, I have been through disciplinary action at work and taken my punishment as it was a fair cop. However during the long winded process a letter explaining the outcome of the investigation and next steps (giving me the date for the actual hearing) was sent to a fellow employee's address (who lives in a different city) to myself and not myself.
    I feel as though it will be common knowledge that I have had disciplinary action taken against myself as a result of this.

    So, I guess what I am asking is whether or not this breeches and data protection and if I have grounds for complaint?

      The incident happened at the end of last year and disciplinary was concluded in January.
      I haven't raised this yet as I wanted to get the disciplinary done sister and over with.*

              As you plan to do, raise a grievance (informally or formally; this is potentially a serious breach, so straight into formal would not be inappropriate). Hopefully your employer will engage with you and be able to resolve your concerns.

              Also, collate the evidence of the breach. How do you know it went to another employee? Have they confirmed this to you? Does the wrong address feature on the envelope? Or the letter itself? Do you have this in your possession? etc.

              Not sure exactly your options beyond of resolving this via the grievance process, although you can certainly talk about the implied (contractual) term of trust and confidence being breached, or at least eroded, alongside a potential breach of the Data Protection Act (which could be reported to the Information Commissioner's Office).
