  • Line manager discloses medical information to 3rd party

    Good evening,

I recently had major surgery for an ongoing issue that has effected me for the last 3 years. I had made my line manager aware that I was to have surgery and informed them that I was given a date late October.

The week prior me going off for said surgery, my line manager informed me that she had been out at the weekend with 3 friends who happened to be nurses. Whilst out, she told the nurses about my surgery and asked how long will it be before I'm back to work, with them saying 3 weeks.

(This 3 week timeline is laughable as I'm not to do any weight bearing walking for 4-6 weeks before starting physio.)

Anyway, I feel that this is totally unprofessional and could go against the Data Protection Act.

I'm looking for advice as how to proceed? Do I contact a senior manager or HR, or do I go direct to my union?

If anyone requires any further information please don't hesitate to ask.

Hi sorry not to respond sooner.

I would suggest that you firstly raise the matter on an informal basis with either a more senior manager or HR. Effectively this should be the first stage prior to raising a formal grievance if the matter is not dealt with satisfactorily.

By all means go to your union if you feel that you need some support in dealing with this matter either now of if the matter is not dealt with and you have to go down a more formal route you can involve them then.

Hope that helps but if you have any more questions then just pop back.
If you would like a one-to-one expert consultation with me on your employment issue than I can be contacted by emailing admin@legalbeaglesgroup.com

I do my best to provide good practical advice, however I do so without liability.
If you have any doubts then do please seek professional legal advice.
