    Hello,

    I am a new subscriber to legalbeagles and wish to embark on a Whistleblowing claim via the Employment Tribunal process and ask for where is the best place to read about it. I am under the impression ACAS is the first step and I would like to take it as far as I can on my own in the early stages. If and when the time comes I expect to engage a barrister via Direct Access. My employer is very large and there will be many others who have been through a ET claim with this firm and it would be very interesting to make contact with such people to compare notes. Any pointers on how to make contact?

    Hi, I am going through a whistleblowing case at the moment, but with no legal guidance. It is very important to get your claim submitted before it is out of time as there is a three month time limit, however if there are circumstances that prevented you starting the claim within three months this may help your case. Curious, what sector do you work in? in what part of the country?

      Hi Roger13, where you dismissed due to whistleblowing or for some other reason but you believe in fact it was really because of your whistleblowing? If so, can you prove the main reason for your dismissal was that you raised concerns about wrongdoing at work? Who did you make the disclosure to, was it your employer or an organisation listed as authorised to deal with such complaints?

      To be protected from dismissal, the information you disclose must be a qualifying disclosure. These relate to:
      1. a criminal offence
      2. a failure to comply with a legal obligation
      3. a miscarriage of justice
      4. a health and safety issue
      5. damage to the environment
      6. an attempt cover up any of the above.
      If you wish to make a claim for unfair dismissal because of whistleblowing, then in the first instance you need to start the early conciliation process with ACAS. Here is the link to ACAS and details of this service.
