    Hi All,

    I recently handed my notice in with my current comp ah to start a new position with another company in a different sector.

    A couple of days ago, I received a voicemail from the company that I was due to start at saying that unfortunately they had some bad news and that the position that I was going too was no longer available. I called them back and they explained that the reason was nothing to do with my references etc it was due to something they were expecting to be completed was not complete. I was not aware that the offer of the job position was dependent on this.

    I had received a condition offer of employment based on sufficient references and medical etc which were all fine.

    I would like some help and advise please on where I can go with this? As I would like to make some sort of complaint to the company as I had met the conditions of the employment offer but the job was still revoked.

    If the offer was conditional upon certain criteria being met such as references etc and you satisfied these then, given that there was a contract offer in place with you, if they wanted to withdraw it and not have you start then they needed to do so in accordance with the terms of the contract. In this case they should pay you in accordance with any notice terms.

    So in terms of contacting the company it would be on the basis of failure to terminate in accordance with the contract which therefore constitutes a breach of contract and for which you require damages to be paid which would be the equivalent of the net salary and cash value of any benefits that you would have received if you had been given notice in accordance with the terms of your contract.
