    I am looking for advice on whether my employet can use a telematic tracker fitted to my company van outside stated purpose. 2014 vehicle tracker policy stated that the data could be used to verify if the vans were being used for non work purposes (legitimate interest being ensuring compliance with HMRC ( but also had in small print that it could be used for 'specific investigation'.).Everyone believed that they were being used for HMRC compliance only and this was confirmed in writing when the question was asked at a forum. The 2018 privacy notice does not mention use of telematic trackers at all. They want to use it in a disciplinary to show me leaving site early - there are no allegations of private use. I spoke to ICO who told me that it is a data protection infringement but the company refute this and claim that because they process employees attendance and hours they have it covered. I do not think this is correct as it is not clear and transparent . Can anyone advise me? I have had no luck trying to speak to a solicitor.

    Is the disciplinary solely due to your having left site early on a couple of occasions or are there other issues too ?

    Presumably you have contracted hours you have to be on site ?

      The disciplinary is only relating to this - I am mobile so am at different sites during the day and complete a time sheet at the end of the day. They have said that they recognise the policy needs to be upated. They have other methods for checking time keeping. They also say that 'they have always had the right' to use it but I thought that GDPR meant that employers had to be transparent about how they will use personal data (ICO say it is personal data).
