  • TUPE Limbo

    So I've got a TUPE problem...starting from the beginning, the Local Authority decided to restructure services and my current small charitable organisation who hold the current contract made a bid for the tender. However, another much larger organisation won this contract.

    We have gone through the consultation period and my current employer has provided us with meetings updating us on the state of play. Our details were provided for the TUPE.

    However, the Local Authority has deemed myself and two other members of my team as un-TUPE-able. My employer has consulted their external HR agency and they disagree with this decision. An official letter from my employer has been sent to the Local Authority regarding the disagreement of their decision and stating that myself and others on my team will arrive on the transfer day, to their premises to attend work.

    The transfer occurs 1st October and we are stuck in this situation, with no official decision having been made. I have been assured by my employer that they are willing to waive any notice needed in my contract if I chose to leave before this date, which I would prefer to do.

    I understand many responses to this may be to get legal assistance on this matter, but I don't have the time, nor the funds currently. I'd really appreciate any sort of advice that can be given, so TIA!

    I'm sorry but I don't understand what advise you are looking for. The TUPE dispute seems to be irrelevant if you want to just leave and your employer is happy for you to do so without notice.

      If another entity has won the contract then, unless they are taking over your employer, then TUPE would seem to be irrelevant

      You are probably going to be reduntant and therefore they would love you to resign
