  • Annual Leave during Internship

    Hi,

    I'm in intern for 9 weeks and was wondering about my entitlement for annual leave.

    1. According to gov.uk I'm entitled to 5.6 weeks of holiday pro rata. For 9 weeks this equals 4.67 days. Does that mean I am entitled to 4, 4.67, or even 5 days of annual leave throughout my internship? How does that translate into hours?
    2. In case I don't take the annual leave would I be entitled to payment in lieu and for how many days/hours would that be?
    3. If my contract contains a clause which states that I'm entitled to less than 5.6 weeks of holiday is it valid?

    1.Assuming you work 5 days per week you are entitled to 4.8 days and your employer can if they want round this up to 5 days.
    Translating that into hours will depend on the number of contractual hours you work per day/week.
    2. If you do not take all or part of your entitlement you will be entitled to be paid all or the untaken part of your entitlement when you leave
    3. If you post up the clause then I can take a look at it to answer this question.

      Hi Ula, thanks for your quick response.

      1. Yes, I'm working Monday to Friday for a total of 40 hours a week. What do you mean by they can round it up? Does that mean they have to or is it in their discretion?
      3. The clause reads 'You will be entitled to 4 days holiday during the lnternship. ln addition to this, you are eligible for paid public and bankholidays, which fall during the lnternship'.

        1. Given the clause you have provided then I can now understand the calculation. 5.6 weeks for someone working 5 days per week is 28 days which can be inclusive of exclusive of bank holidays. Effectively your company to make the 28 days gives 20 days plus paid bank holidays of which there are 8 in the UK giving 28 days. So to breakdown how they have calculated your holiday entitlement it would be 20 days/52 weeks x the 9 weeks you are working which equals 3.46 days which they have rounded up to 4 days. In addition if there is a bank holiday whilst you are on the 9 weeks then this will be paid holiday. Hope that makes sense.
        3. Clause 3 is correct since you are being given your correct holiday entitlement.
