    I have a case ongoing against my former employer which is due to go to tribunal hearing mid september
    I know who i need to be witnesses for me but at least two of them were formerly employed by the same company and mysteriously disappeared i believe they signed NDA agreements as part of their pay offs
    can the tribunal order my respondent to divulge contact details for these potential witnesses and can they also order such witnesses to appear at the tribunal or give statements in relation to my claim

    I am really not sure whether the tribunal can order the respondent to divulge contact details of the witnesses to you since there would in all probability be a GDPR issue. It may be worth phoning the Tribunal first and ask the question.

    Before a tribunal can make an order for a witness to appear at a tribunal you would have needed to contact the individual to ask them to be a witness. If they refuse or do not respond then you can write to the tribunal and make the application. In the application to the tribunal you will have to state why the witness is needed and what evidence you believe they will provide in support of your claim.

    My word of caution though is a reluctant witness does not always make a helpful witness.

      Thanks for your advice on this I have until 18th to put my statement in and send any documents the respondent have indicated they wish to add to their bundle.
      its all very daunting going up against a public employer with no assistance no legal aide no union and no i.t skills
      ​​​​​​I do have determination and an 8 year history of a toxic workplace which led to me feeling forced to resign .
      Copies of my HR records show a sustained and deliberate campaign to defame my good character in order to cover bad working practices .
      It's always useful to have online forums to gain advice and support from .
