  • Can I demand Severance in case of forced resignation ?

    Hi,

    My job is located in North Carolina and I have been working with the company for 8 years.
    Due to personal reasons, I have been working remotely from my home country (for 4 months) to care for my family. ( NOTE : I am not a US citizen or Green Card holder )
    My company did not agree to continue this remote work arrangement, and wanted me to return to NC, failing which I have to resign by next month.
    Although my position does not demand a physical presence in NC, I understand the company policy, however I am not sure if I am eligible for severance.

    On the termination policy, my case for eligibility for severance comes under job loss NOT due to performance or job elimination or a discharge. I was even awarded a promotion earlier this year.

    Company HR has denied a severance pay stating the position is in NC and they are not willing to permit a remote work arrangement.

    Need guidance as this has left me with no job at the moment and a severance could help me out in the short term while I look for another job.

    Hi Sam771, you have come through to a UK website and our experience only covers UK law. I presume that as you are employed by a US company it will be covered by US employment law.
