  • Resigned and disapinacy

Hi I've handed my notice in and am due to finish in 10 days but been called in today to say that they think I've done something wrong which has ended in them taking me to disaplinary. I have been suspended with pay. I start new job on 1st of July. So do I have to attend the disaplinary meeting when I get the letter

Yes your employer can still take disciplinary action against you whilst you are on notice, you are still an employee of the company.

If the alleged wrong-doing was something of a serious nature it could warrant summary dismissal and an immediate termination of your employment even if there is still some time to serve on your notice.
If you would like a one-to-one expert consultation with me on your employment issue than I can be contacted by emailing admin@legalbeaglesgroup.com

I do not provide advice by PM although I may on occasion ask you to send me documents this way but any related advice will be provided back on your thread.

I do my best to provide good practical advice, however I do so without liability.

Thanks for that information they said I could left today without pay and they would forget it. Or I could be suspended with pay and have a investigation. Due to me not doing what they have said I did have have gone for the 2nd option but due to starting a new job I'm worried about having to take time off new job for the discipliney hearing.

The disciplinary meeting should be before you leave whilst you are still an employee of the company.

I asked today when meeting will take place and I've been told that they need to do an investigation and it won't be until at least beginning of July.

What are the assertions being made about you?

It seems to me, from what you write that the options of leave now - no pay vs stay and we will investigate your alleged misconduct has the taint of dishonesty about it, but without the facts ....?

Do u mean dishonesty by me or by my work place

I said I have completed some paperwork and they said I didn't complete it with a pa. Then they have looked at a PDR I completed last year with same pa and have now said I forged her signature. Which I have not done.

Hang on - first there is an investigation - that can only have one of two outcomes. Either there are grounds for a disciplinary hearing, or there are not. If you employer is telling you there will be a disciplinary hearing, (yr post 5} before the investigation has even commenced, then he has hopelessly compromised himself.

On what date was the assertion of forgery made? On what date did you tender your resignation? On what date, pursuant to that resignation, does your employment end? Are you registered with the Nursing & Midwifery Council?

You misunderstood the question - On what date was the assertion of forgery made to you by your employer? That cannot be the date on which the forgery is alleged to have occurred.
