  • is there anything i can do after solictors error ?

    Hi all ,im hoping for some advice regarding a disability discrimination and constructive dismissal claim of mine that my solicitor messed up ,my 3 month window to pursue the claim was 07/03/19 and the solicitor submitted the forms /application on the day prior to this date ,
    however im told days later that she had made a clerical error and had stated that instead of suing my previous employer she had put her own name in on that section so therefore applied to sue herself ,she the told me if she withdrew the form we would miss the deadline anyway so nothing can be done .

    after a conversation with a friend of a friend ive been told that the information the solicitor gave me was incorrect and i could apply to still pursue a claim ,they just werent clear how
    is there anything i can do this far on ?or have i lost my opportunity to pursue it ?

    I believe but am not certain, that your solicitors could have made an application to the Tribunal to amend the respondent’s name. I presume the claim was withdrawn by the solicitor when they discovered the error rather than make an application to the Tribunal to see if the amendment could be made.

    I would also see if you can find an employment solicitor who does a free/reduced fee first appointment to find out whether given the situation you may get leave to make extend the time in which you can make the claim.

    Have you made a complaint to the law firm? If so I would suggest that is something that you should do since potentially this is professional negligence claim against the firm.
