  • Employer failing to provide crucial data in SAR

I have a long running issue with my employer. It centred around a grievance from 2.5 year ago, which was only concluded, unsatisfactorily for me, 6 months ago. I put in a SAR in January, asking for all data, emails, logs, calls, etc.. and data was missing the first time. I enquired, they seemed to set up SAR 2, more data came, but again, missing meeting minutes which are crucial to me proving their grievance process is corrupt. 3 times I have emailed them stating these minutes are missing. They said the manger no longer works there, and therefore then can't find them.

I work for a company employing 10k people on my site alone. This manager would hold nothing, and it would be HR who had all of the data, which they digitise as usual process dictates.

There are elements within HR trying to protect themselves. Is an ICO complaint my only option? I have made that threat in the last 2 final emails...

If you have gone back to your employer and been specific in the second SAR as to what information you think was missing from what was provided following your first SAR request and it has not been provided and you are not happy with their explanation then the next step would be to either raise an internal grievance - but I know the issues you have had with regard to how your employer handles grievances or you make a complaint to the ICO.
If you would like a one-to-one expert consultation with me on your employment issue than I can be contacted by emailing admin@legalbeaglesgroup.com

I do not provide advice by PM although I may on occasion ask you to send me documents this way but any related advice will be provided back on your thread.

I do my best to provide good practical advice, however I do so without liability.
