  • Being sacked unfairly

Hello, so iv been in my employment for 2.5years as a nanny and always worked 3days a week. I'm 3months pregnant and my boss has said I need to work 4days 9-5 or she's going to find someone else. Iv said I can't work more than 3days. So she's said she's got to sack me. Also she said even if I did work the 4days for now when my baby comes she's going to replace me anyway. I'm going to miss out on my maternity pay if she makes me leave now! Any advice would be a huge help. Thank you.

Sorry to hear about your situation. Are you employed directly by the family and have a contract of employment?

Since the threat to sack you is not about your pregnancy but about not being able to increase your hours and you have been employed for longer than 2 years you have accrued statutory employment rights which means if you are dismissed unfairly there is a potential to bring an unfair dismissal claim.

In regard to the scenario of were you able to increase your hours to accommodate, when it became time for you to go on maternity leave you would be entitled to all your rights to maternity leave and pay.
If you would like a one-to-one expert consultation with me on your employment issue than I can be contacted by emailing admin@legalbeaglesgroup.com
