    Hello

    My employer has advised me that employees are only allowed 5 sick days per 12 month rolling period before they start deducting daily wage for each day we are off work. That's 5 days per year in total!

    So for example if an employee is off work for 3 days in Jan, then another 3 days in March, they will stop paying on the 3rd sick day in March. Any subsequent days off are not paid. Is this legal?

    Is this the company's current sick pay policy or are they trying to make changes.

    If the former then yes the company can determine what it pays in addition to statutory sick pay. Any policy that the company has to pay sickness absence will not affect an employee's statutory right to SSP.

    If the company is changing its policy then is it a contractual policy or not? How much notice has the employer given of the change?
