  • Letter of concern outside of working hours

    I was recently at work on my day off having a drink at the bar. I insulted one of the bar staff and left, which I have since apologised for. But my employer is talking about giving me a letter of concern for the remark I made, even though I wasn’t on shift?!?!? Can they do this??

    I presume a letter of concern is an initial stage of your company’s disciplinary policy?

    Unfortunately, yes an employer can take disciplinary action, based on an employee's conduct outside of working hours, provided the conduct outside of work has a bearing on the employment relationship. In this instance your employer may feel that since, although you were off shift, you insulted a colleague that your actions fall into this category.
