  • Help with Employment Tribunal Claim form Wording

    Think i’ve bitten off more than I can chew here and seeking help.

    My my partner has worked for A big well known airline for the past 7 years in the accounts department. To cut a long story short, she picked up pelvic girdle pain (PGP) during her pregnancy in 2017 and after her maternity leave finished was signed off sick. After a period of time she went through the process of requesting reduced hours and had a letter of support from her doctor. There was a formal meeting followed by a request to attend the company’s occupational health (who also backed up the doctors recommendations) but the request was denied. We then appealed to no avail. We took legal advice and was told we have a claim for sexual discrimination because PGP only affects women. They also said they think we are coming at this from the wrong angle as we should have requested “a reasonable adjustment for disability“ as this is a lot harder to refuse. We have sent a template letter requesting this and although we have had an acknowledgement, we haven’t heard anything else.

    We we have been through ACAS who have tried to mediate but have been unsuccessful due to the company outsourcing everything. We have been issued two certificates from ACAS as i’m aware of the tight timescales involved with issuing a employment Tribunal claim and we are just within this period. As I’ve said previously, Im dealing with the claim mainly for financial constraints. im really looking for some help with the wording for the employment Tribunal claim form (ET1) I know the wording on this form is very important and once submitted can’t be amended.

    Based on the advice you have received so far, I presume that you are putting in an ET claim for disability and sex discrimination?
    The letter that you have raised with your partner’s employer that is awaiting a response is that on the basis of making a reasonable adjustment due to disability?
    When have you been advised that the ET claim needs to be submitted by to be within time?
    Are the two certificates from ACAS for early reconciliation and are they both for the failed request for flexible working i.e. reduced hours?

    So in 8.2 of the form you need to state what happened in numbered paragraphs:

    Detail the nature of the claim i.e. disability with details of the disability and detail the Equality Act 2010 and which section is applicable to the claim
    Detail as above for sex discrimination
    Detail when your partner submitted her initial request, what that request was and when it was submitted
    If there was a meeting to discuss the request, brief details of that with dates
    Outcome of the meeting, reasons by the company for the refusal to accept the request, how this was notified with dates.
    Etc until you have detailed everything relevant in as concise a way as possible

    Then as this is a discrimination claim at 9 you need to complete what you would like the Employment Tribunal to do for your partner.
