  • Dissmssed due to DBS spent conviction.

    Hi,

    I started a job in November as a cleaning supervisor in a local academy, I disclosed my previous conviction which was supplying class A drugs. This was 23 years ago and I was completely different person
    back then and in a bad place.

    I have recently worked with the local authority in the homeless sector and also rehabilitation to substance misuse and I am currently involved in the consultation with the Ministry of Justice to advise and implement new framework for the rehabilitation of offenders ( how ironic)

    I worked at the school for 3 months my DBS had came though after 6 weeks the company I worked for asked me to fill in more forms so I could elaborate further on my conviction, HR felt that the school should be made aware I had previous convictions (not stating what conviction) during this conversation my manager disclosed what my conviction was to the school because he knew I could provide evidence of rehabilitation, however the head master and deputy head refused to accept this and subsequently I was dismissed from working at the school.

    Could anybody advise me about my rights please

    the question is, who were you employed by first of all, if you were a contractor then sadly it is up to the school who they have on their premises. Ula may be able to help you more here as employment law isnt my area of expertise

      Is your contract of employment with the local academy or via a contract cleaning company? Do you know that came back on the DBS that required the need for further forms to be complete and what was their purpose?
