    Hello

    Been employed for same company for 10 years. Had a recent new contract and had some concerns about it.

    There was a contract of employment also a side letter with changes to my current contract.

    1) Currently work on a salary basis 8 hours a day with paid breaks.

    They have sent me a recent letter of a 2.5% increase (thank you)


    New contract states that they i will no longer get a paid break deducting 30 mins per day. This works out to a reduction of 11% in salary over the year.

    I told them of my concerns and the come back and said actually you will stay as you are now so ill get my paid breaks.



    2) Contract says ill get a weekly pay (which is what i get now) The side letter says its changing to monthly pay (but contract still says weekly) They plan to change the pattern to monthly still i have had that cleared up.


    3) New contract says i must have a driving licence (i dont have one i dont drive) I asked about this and they say we dont plan to enforce it

    It seems someone hasnt done there homework and its a right shambles.


    Ideally id accept the unpaid breaks but for them to increase to salary by the amount i would lose out on.

    There is no word of them issuing another new contract to show the items they are back tracking on.



    Can anyone advise where i stand on this

    A contract should reflect the actual terms of employment that you are working.

    This can be done one of either two ways replace the old for new in its entirety ensuring things like continuous service are maintained and that it is made clear that this is a new contract and supersedes the previous one or prepare a variation document which refers to the date of the original contract and the clauses that are being varied with details of the new terms that are coming into force with an effective date for them. Whichever way the changes are reflective the document should be signed and dated by the company and you.

    Have they been undergoing a consultation with you in regard to these changes?
