  • Office Move and discrimination. Advice needed

    I would like to seek an advice in regards to current work situation. I joined a company in 2007, which was local to me (15 minutes’ walk away). I had a car accident in 2012, the pain condition is currently ongoing since then, Risk assessment done every year and OH done by 3rd party on 3rd company in 2018 . Company decided to move office to the other town. In 1:1 consultation (July 2018) I have mentioned my concerns in regards to risk to get my back pain condition worst due to travelling. All my concerned were ignored. I have highlighted same concerns in other 4 meetings with them. HR and Team management did not bother to look in to serous health condition. I am not registered as a disable person. However, due to long term and ongaoing health issue I believe they need to consider me under Equality act.
    In December 2018 office moved to new location. The 4 hours journey aggregated the back pain. I am unable to walk until now. My health and wellbeing were ignored by HR and team management.
    Am I entitled to get redundancy; I was refused during 1:1 consultation in July 2018 and also later on during meeting with team management. The company mentioned that redundancy is not an option for anyone. My two colleagues have been paid off.
    Request refused to moved to other city (other branch of the company) due to the reason as there is no department foot print in other office as I have family over there. I found that one of my colleague from different department has been moved to the other office in different city. Please be aware that her department has no foot print in the other office.
    Company refused to let me work from home. I have no other choice.
    Please advise what options I have got left. Please advise me on what grounds I can peruse my case?

    Couple of questions first so I can get a better understanding of your situation.

    1. How far away is the new location from the old location?
    2. You say that you mentioned your concerns but have you put this in writing and if so when and what did you say in that written correspondence?
    3. Have you worked at the new location for any period of time since the move in Dec 2018? It appears you may have done but then have been off sick.
    4. If you have been off sick has this been covered by a GP's Fitness to Work Certificate and if so what was the reason given?
    5. How far away is the city where you requested to be moved to?
