I'm seeking some advice for my partner who I feel has been treated very shabbily at work. However her situation is such that the legal position is not clear to me.
She was employed by an agency on a Temp to Permanent basis, on a 3 month contract and was given to understand that if her performance was satisfactory and she fitted into the team then she would be transferred onto the permanent staff at the end of this.
Things were going well. She was constantly told she was doing well and picking things up much more quickly than expected.
Unfortunately at the two month point she got sent home at Lunchtime on a Friday after having a small anxiety attack. She was happy to take her lunch and then co e back but her boss said he wanted her to take the afternoon.
On Monday morning after about 2 hours she was called into the office and told that her services were no longer required because of her mental health problems. Her contract had already been terminated with the agency on Friday afternoon.
They new she was on medication for depression and anxiety, and also knew that she was under a lot of pressure having just been served notice on her 'rented home, had her housing benefit and tax credits stopped because she was earning too much and been told by the rental agency that her earnings would not pass their checks because she was only temporary.
This was the only time she had any sickness or absence. She had been told the previous week that she was doing well.
It seems that she was let go purely because of one anxiety attack.
I know that can't be right but is there any legal recourse?
