  • Holiday Pay Deductions

    Hello,

    My partner is having issues with her employer and we are looking for advice. She has just returned from maternity and at the end of her maternity period her Grandmother unfortunately passed away so she requested a few weeks holiday at the end of the maternity period. This was granted by her manager, however when it came to payday we discovered she had received almost nothing in her pay packet (one weeks statutory maternity pay). Investigation discovered the business owner had veto'd the request and not informed us because he claimed with it being a new tax year my partner had not accumulated any holiday allowance. This is not standard procedure for the business and while if she had quit her job he would have grounds to reclaim the holiday allowance there was no good reason to block the holiday request. After much grovelling and crying poverty (he literally left us practically penny less for the month) he agreed to pay 2 weeks holiday pay.

    A month back in work and pay day comes around again only to discover he has messed up her wages by paying 2 weeks holiday allowance that someone else had requested which he now demands we bank transfer the holiday pay to its intended recipient. On top of that he has deducted 2 weeks pay from my partner claiming that last month's holiday pay that we managed to beg off him was advanced holiday pay and therefore she wasn't entitled and he had reclaimed it. Again leaving us penniless for the month.

    She's feeling like she has to quit now as it seems every month since she has returned the owner has found an excuse to cut her wages back to an unliveably small amount.

    I don't know if we have any grounds to defend ourselves against the owner or whether the only option is to quit and go elsewhere?

    A couple of questions for you:

    1. Did your partner take the full 12 months maternity leave? If not, how much?
    2. Did she take a long holiday immediately before her maternity leave started?
