  • FINISHED APPRENTICESHIP - SACKED UNFAIRLY - 2k TRAINING BILL!

    Hi! Some information would be gratefully appreciated.
    My daughter has completed an apprenticeship, December 2017, she stayed working at the company, 1 week before her 21st birthday (January) they said she made an error, was stopped £60 out of her wages, said come in 5 days, get paid 3, the other two would be training for a two week period, accept this or 'walk'. She accepted this, was paid £126.00 a week. This NEVER stopped! she continued to work a full working week including overtime and still got paid £126.00. This carried on for 9 weeks, my daughter asked on numerous occasions why she wasn't being paid correctly, answer: You don't earn me enough money. Out of the blue she was sent home, then rang up by a disqualified director to say she was fired and never come back to the premises. When the paperwork came through they claimed it was gross misconduct. They sacked another girl at the same time and neither have a clue to the reason they were dismissed. Now the company are demanding the best side of 2K for training which she was forced to attend. She didn't have an apprentice contract but a contract that the other staff members had however there was a statement that she has to pay back money, however, when she ended her apprenticeship in December up until her dismissal mid March 2018 she didn't get offered/signed another contract. Is she liable for these costs? I was under the impression that as an apprentice the company was liable? Thank you.

    Sorry to hear about your daughter's situation. I need to ask some further questions in order to provide some guidance.

    How was your daughters original apprenticeship set up - was it direct with the company or via a training agency?

    Has she had any contract with the company and how long was she on the apprenticeship?

    Did the training for which the company is claiming the 2k take place whilst she was an apprentice?

    From your post is seems like after her apprenticeship she worked for 5 days per week but was only paid for 3? How many hours did she work in total per week?
