TLDR: my employer took 1k out of my accrued holiday leave!
Context: in May 2017 I was assaulted by a manager and this caused me to take sick leave.
I was paid standard SSP until November 2017 when I had to move over to ESA. That took till January 2018 and I haven’t received a penny before or after since finishing SSP.
In February 2018 I gave in my notice and my employer made me aware they would pay me 23.5 days holiday (around £1300) I had accrued that year due to be paid today on the 23rd March 2018.
Today I find I have been paid £365.63 after a deduction of £956.25 of ‘sick unpaid’!
For confidentiality reason a son I can’t scan a cop of my pay slip but the deductions are worked out as follows:
outstanding holiday 23.5 @ £56.25 = £1321.88
sick unpaid 127.5 @ £7.5 = £956.25
total payment - £365.63
Below I have included the initial email conversation I have had with work. Nothing more can be done till Monday I just need advice really badly! I don’t know how they can do this!
“I have spoken to finance and they have advised that your sick pay is deducted in arears, so the unpaid sickness has been deducted from your outstanding holiday.”
