In September I had no option to resign from my job claiming constructive dismissal, bullying and harassment and disability discrimination, I went through the formal grievance process and several of my points have been partially unhelped. I have started the process with ACAS and I worked out the value of my claim to be just over £16'000. £3900 which would have been statutory redundancy, 4800 loss of wages up to Jan 2018 when I'm due to start new training and the rest of discrimination, bullying and harassment and distress caused.
I recently received an email from ACAS to say my employer's rep has been in touch and although they are content they will be able to defend the case if it went to tribunal, However they are willing to try and come to an agreement to settle your case to save you both the time of litigation. They are making me an offer of £4500 with all the usual gag clauses.
I know if I take it to a tribunal I risk getting nothing and losing but I am also content that I have a case, do people normally accept the first offer? plus it does not say anything about a reference, I worked for the company for 10 years so it would be hard to explain why my employer of 10 years may not give me a reference, I just want a glowing reference just an acceptable one.
Any advice?
