    I have had my employment terminated because of the result of my DBS.
    The role i was employed for was a facilities manager for a private investment company looking after the client offices dealing with all aspects of health and safety and building management. At the time of my application for the role i was not asked to disclose any information as i have been working in the finance industry for over 7 years and never had any problems before in my offer letter for the role they advised successful candidate will be subject to back ground checks.
    To my surprise after working for the company for 4 months they advised they have just received my DBS and have decided to terminate my contract they did not allow me to discuss or appeal and just said was company policy.
    I would like some advice on this yes my dbs did show that i had convections for consipire for theft offences however the sentences were suspended and happend in 1989 !! and a few drink driving offencesin 2002 and 2003 both which were fine.
    Is it legal for a company discrimination against me for things thats happed over 20 years ago and considering i have worked in the finance industry for over 7 years and no other issued occurred?
    I understand employers have to protect the business and who they employs however i am hardly a high risk??? Any advice

    I suspect that your employer does think that you are a risk, they did advise you that they would carry out a DBS, the sacking was as a result of them receiving your DBS.

      Because the offence resulted in a custodial sentence?? (even though it was suspended) it won't come off of your DBS record. ROA does exempt Financial services positions, and although you are not working directly in financial services as such, but as a manager responsible for the buildings management I suspect you would still be subject to the standard DBS disclosure.

      Financial Services position –This means all positions for which the Financial Conduct Authority (previously the Financial Services Authority)or the competent authority for listings are entitled to ask exempted questions to fulfil their obligations under the Financial Services and Markets Act 2000
      Did you ask for a copy of the company policy on criminal records checks?
