  • Nolans/Cabot Court threat letter... SOS!

    I'm hoping for some advice or pointers on how to handle a debt recovery situation....

    I've received a letter from Nolans Solicitors saying that if I don't pay an old debt of approx £1300 within 7 days or make an acceptable payment proposal, they may raise court proceedings against me. The court decree would be valid for 20 years.

    I am not sure if I do owe this money, however I have had a turbulent few years so I may do! Currently I am unemployed but classed as a carer for my two disabled children.

    Any advice would be greatly appreciated

    Welcome to LB

    I take it that you live in Scotland.

    Try to stay calm, your priority are your children, everything else is secondary.

    a) Have you made a payment in the last 5 years? Have you every acknowledge the debt in the last 5 years?

    If the answers to the above questions is 'yes', then the debt might be 'statute barred'.

    b) What you could do is fill in a Income and Expenditure form (take into account the cost of living, energy, food etc), send it in with a covering letter, explain that 'I am unemployed but classed as a carer for my two disabled children.' Make sure you get Proof of Postage. If you can't make payments, it is pointless them taking you to Court.

    c) Because you are a carer for your two disabled children, you could ask them to 'write off' the debt, again get Proof of Postage.
