    Hi all,
    Having an issue with a courier company and looking for some advice before deciding how to proceed.

    On Nov 18th I booked a set of wheels to be shipped via SHIPLY, for those of you unfamiliar you put a request out and multiple couriers quote against it. You pick who is best for you then proceed with them. Booked under the basis that the items would be delivered by the 28th.

    The guy let me know on a Sunday afternoon that he would be collecting first thing on a Monday, I tried to reach him on the phone but he never answers. Anyway tried my best to accommodate this but I had to cancel the booking at 7:50AM on Monday due to a family emergency. I asked when they could rebooked, eventually they came back with the 3rd which was a week later and unsuitable.

    Now this is where things get interesting, I had to deliver the wheels myself so the customer had the item in time and cancel the booking completely as it would not be done before the 28th. I don’t expect people to do something for nothing, and although he didn’t answer his phone whilst giving last minute notice I would normally be happy to contribute to the cost of the last minute cancellation but he tries to charge me for BOTH deliveries.. this is with several days notice for the 2nd time after trying to reach him on his phone with no success.

    To cut to the chase, I received the attached letter in the post. Originally booking was £40, the cost he seems to be adding up as he goes along and looking into him he has several people taking him to court over debt and damage. Please advise what the best course of action is, if it goes to small claims court will there be additional cost to pay, do I need to pay at all, shall I offer to pay for the first collection but the rest is unreasonable?

    Not once has the guy called me for an actual conversation, never been in this situation before and never come across someone so ridiculous. It isn’t really about the money and more about the principle of him attempting to charge for a job he hasn’t even done the 2nd time round.

      Acknowledge Claim - within 14 days from Service

      Defend Claim - within 28 days from Service (IF you acknowledged in time)

      If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
