Lowell letter before action

I have received a letter before action stating if I don’t return the form within 30 days they will take court action. The letter turned up 10 days after the date on the letter and I returned the form within 3 days of it arriving I phoned up today asking what was happening and they said court action had been taken as we hadn’t received a response. I sent the form back with a offer of repayment and asking to for a copy of the contact.
