  • Premier Park threatening with court action

    Dear all

    This situation has been ongoing for over a year now. Premier Park that runs the parking for the local Vue cinema has been chasing me for "overstaying" in their car park. There's just one problem - my car wasn't parked in their car park. They have an ANPR photo of my car entering and exiting the complex via Mayson St (attached), but no evidence I was in one of their spaces. That same public road leads right past their car park and to the train station car park, which is run by Arriva. That's where the car was.

    I am attaching a copy of the letter I sent them and some Google maps. My question is, should I offer them £5 to make them go away?

        I originally sent this letter to the parking company. They responded by passing the case to their lawyers after refusing to provide any evidence I was ever in their car park.

        Should I send the same letter again, to the lawyers?

          Ask them that if they intend to start proceedings you require all documentation that they intend to rely on in courg

            The legal letter says:
            "If payment or a response is not received by 29 Aug 2019 we are instructed to issue a CCC without further reference to you, together with applying the interest, fees and costs"

            Does that mean they'll take me to court without telling when or where this will take place? Can they even do that?

              No they have to issue a claim through Money Claim Online. They can't do it without your knowledge. They can add the solicitor fees of £50 and court fee of £25 to the claim.

              Send a SAR request to Premier to get all the documents the parking company hold. They have 30 days to comply.

                This is madness. How can they set up ANPR to police their car park on a road that also leads to a completely separate car park??
