  • Hi - letter of claim disputed phone contract debt.

    Dealing with a letter before action on mobile phone account from 2015 brought by Debt Purchaser still have several accounts all pay monthly with company regularly upgraded phones since no issues in fact pestered to upgrade shown as all accounts good Issue on one account of the six I ran with them disputed at time written to repeatedly sent recorded no reply I am puzzled to start with as claim is for two seperate conntracts rolled into one debt allegedly defaulting after 24 month contract period expired and showing payments made by direct debit after the service was disconnected how much info should I give them in reply form?

      Hiya, It's fine here to start with ( maybe use a more descriptive title next time though ) but I'll move you to the court forum in a bit xxx

      So what's the situation - you've received chasing letters from a debt purchaser and now a letter of claim threating court action with a reply form ? ... but the original debt was in dispute with the phone company, and you still have other accounts live with the phone company....

      A SAR to the phone company would help gather the info on the debt and how the account ended, and anything on the complaint/dispute they might have.

      And reply on the reply form asking for details of the debt - agreement, statements, copy of final bill and how the sum claimed has arisen, default or termination notice, and notice of assignment.

        I have still have three accounts pay momthly with O2 renewed over and over again used to have more Capita who ran the system for o2 claimed a non payment of £10 Bank staement shows it paid account was over 24 months duration running then on thirty day rolling accountso max even if non payment notice sent to them for stopping service without cause written to three times as bank statements show all paid no response payments made till service stopped on some accounts rest running to date fine have had offers of 50% + to settle "Debt" no response other than Computer generated default notices
        this is adispute over £10 that was never resolved turnrned into a 1500 alleged debt

          I suppose my basic issues are:
          • These were two seperate accounts which may very well have different defense criteria but they have been amalagamated into one amount
          • I dont know at this stage how much of my bank statements showing correct payments made letters to vendor copies of recorded delivery etc paid off accounts showing exemplary payment history over10+ years I should send
          • I am going for do not owe this alleged debt and will send sar but have most of the detail filed away
          Any help would be appreciated
