  • County Court claim form.

    Hi, I have no idea if I'm in the right place or not but I could use some advice.

    I have been sent a county court claim form for a debt to orange which was put on my file in error.

    Basically around 3-4 years ago my orange contract was up and I had organised for it to be closed, I paid off the remaining balance owed and as far as I was aware everything was in order. About 6-8 months ago I got a letter from Lowell claiming I owed them money from this orange account which hadn't been closed and I now have a default on my account. Obviously I was furious and after many discussions with both lowell and orange, orange finally admitted that it was an error, they would remove the default and the debt would be removed, (this had been confirmed by 2 separate people that the debt was an error) this never happened and when I spoke to lowell, telling them the situation, they said "we won't contact orange to find out if you're correct" and orange said "no we can't contact lowell to inform them and can't give you an official correspondence to confirm our mistake" so I decided to contact the citizens advice bureau for help but nearly 2 weeks later and still no response from them, now today I have been sent this county court claim letter. To top it all off the claim number and password on the letter must be incorrect as I can't log in to dispute it online.
    I'm at my wits end with this so any help or advice would be greatly appreciated. I'm saving for my wedding and a deposit for a house so this couldn't be a worse situation right now.

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
