      It's the complexity of the make up of groups of companies, as the regulator has taken

          There is however no harm in mentioning in defence that the claimant appear not to be authorised by the FCA,
          it may well prompt a an answer from the solicitors.

              I don't think it will actually help, but if need be it can be put in a witness statement later.

                  [MENTION=55034]nemesis45[/MENTION] just thought I'd tell you received a letter today from weightmans saying pursuant to the order of the county court business centre, please find enclosed the claimants completed questionnaire in relation to the above proceedings. Basically it's the small claims questionnaire filled out by weightmans. Am I supposed to have this ??? I'm sending my questionnaires off tomorrow . Would appreciate any advice. Xx

                    Yes that's its what Weightmans has filed with court now you serve you serve your questionnaire on the court and Weightmans.

                          spoke to soon [MENTION=29921]nemesis[/MENTION] a lady called lauren has just left a message for me on my answer phone regarding mediation I have to ring her back , I,m scared now. what do I say to her. I didn't think it would come this far and feel lilke throwing the towel in now

                              Mediation isn't scary,honestly

                              You won't be speaking to weightmans, just the mediation lady, she will speak to weightmans then she will pass what they say back on to you.

                                You still haven't had any docs from them have you ? You just need to tell the lady you can't negotiate anything as the claimants haven't provided any evidence of the debt or that they are entitled to claim it from you. You have sent them letters asking for documents which they have acknowledged but nothing has been forthcoming.

                                Acknowledge Claim - within 14 days from Service

                                Defend Claim - within 28 days from Service (IF you acknowledged in time)

                                If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
