    If they try anything about the agreement provided was an error and they need more time to get the right one... then mention they have had since January when they issued the claim to provide the orignal agreement, but you don't believe they can because you never signed one.

    Your Witness Statement will do most of the talking for you, but have a copy to hand to refer to if you need it. Also have a copy of your defence with you.

    You'll also want their WS and all their evidence they have provided so far, so you can check things as they talk and dispute any new or misleading stuff they bring up in court.

    @pt2537 @Diana M; obvs have much more experience in court hearings ( I've only been to a couple, just read lots of accounts on here from other people who have been through them ) so should be able to give you some more tips xxx

    Still hoping they read your WS and decide they're better off ditching the case though
    Thank you for all this. Do you think with so little time they will stop the hearing even if they think we have a strong WS? Also this might be silly but at the beginnig you ordered over the phone but towards the end I ordered online choosing to spread over 12 or more months therefore having interests charge as it says on my WS. so I have agreed to some interest.... I guess still there is the issue of no contract etc....?

        Yes there was still no consumer credit agreement in place.

        Re point 5 - do we have a full transaction list on the account yet ? Then you'd be able to see how much you have paid over the years vs how much the goods cost that you ordered if you take out any interest/charges etc. ( it shouldn't matter as if there is no agreement the entire debt is unenforceable)

          So I was hoping for the case to b discontinued but i guess I am kidding myself as it is over 10000 . No post has come and I was wondering if it is any good to phone the court and find out if hearing is still on or should I just turn up?

              Been up early going through all papers make sure I have everything with me. I keep reading the claimants defence but nothing sticks I . Not sure if i will be able to follow it all. Last night I had an awful. Ugh this and I was not feeling very well. Today I got up with an enormous headache. I will wait for after 9 am and will phone the court. The hearing is. It until 2pm so plenty of time. Hope anxiety get easier. Any last tips??

                I asked if I was going to have something in writing but they said no that that was it. ??

                      I know I sound naive but do I just trust the telephone call? And is this it? is it over for good?

                        As [MENTION=3599]MIKE770[/MENTION] has said the court should send formal notice that the claim has been discontinued.
                        Check again later and ask for written notice.

                          You should get a copy of the notice of discontinuance from the claimant and from the court. Depends when they filed it with court but you might get it today. Good job you rang xxxx

                          and yes, so long as the court weren't just lying ( they won't have been ) then that is it.
