  • Settlement agreed, what now?

    I issued a claim in the small claims track.

    I have agreed a settlement with the defendant but not for the full amount. He has said that he will issue payment on receipt of confirmation from the Court that the case has been concluded.

    Do I need to get any sort of order from the court to this effect or is it simply enough for me to tell them that I have settled or withdrawn the claim, I assume that the Court will then send out confirmation to this effect?

    And you need the payment to be made before you withdraw the claim. Awkward.

    Why not draw up an agreement, signed by you both and with witnesses, that states that on the receipt of the agreed sum you will take no further action in the claim. This means that if you did not cancel the case then the defendant could show the court the signed agreement and get the case rejected?

    You can tell the court that you are discontinuing the claim. There should be instructions about this in the paperwork you received from the court.

    Acknowledge Claim - within 14 days from Service

    Defend Claim - within 28 days from Service (IF you acknowledged in time)

    If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
