Re: Claim Form Received - BW Legal / Lowell / Littlewoods - Help Needed

I have initially started to fill in n224 form out on my PC in Adobe but it will not save - saying it will only save as a blank.

Is it acceptable then to fill in the form by hand, scan it into the PC and send the form that way?

Could I just get some help in filling out the N244 form I just want to check I have it all filled in correctly…

Name of Court – Northampton County Court

Claim No. – The claim number I was given on the Claim Form sent to me by Lowell Portfolio 1 Ltd, and their legal representative BW Legal

        Claimants Name – ME

Defendents Name – Lowell Portfolio 1 Ltd
        //OR DO I PUT BW LEGAL?//

Date – Date I apply for order

1.What is your Name – MY NAME

        2.Are you – CLAIMANT
//I PUT CLAIMANT THIS TIME BECAUSE I AM THE ONE MAKING THE APPLICATION?//

3.What order are you asking the court to make and why?
An order (a draft of which is attached) that the Claimant do provide the Defendant with documents mentioned within the statement of case pursuant to CPR Rule 31.14 and that the Defendant thereafter do have leave to file a Defence.
The Defendant also seeks the costs of the application.

4.Have you attached a draft of the order you are applying for? – YES

5.How do you want to have this application dealt with? – AT A HEARING/WITHOUT A HEARING (still undecided how I feel because of nerves)

6.How long do you think the hearing will last – I read it was best not to guess and if you didn’t know just leave it blank, so I leave it blank?

7.Give the details of any fixed trial dates or period – Leave Blank

8.What level of Judge does your hearing need – District Judge

9.Who should be served this application – Lowell Portfolio 1 Ltd

10.What information will you be relying on, in support of our application? – TICK ‘the attached witness statement’ & in big box below do as M1 says by station see attached…

Sorry for being daft, but does this mean I simply put the word 'Claimant' in that box and not the company name

Re: Claim Form Received - BW Legal / Lowell / Littlewoods - Help Needed

Before District Judge Sitting at the Northampton County Court CC BC, 4th floor, St Katharine's House, 21-27 St Katharine's Street, Northampton Northamptonshire, NN1 2LH, on the day of 2014

UPON reading the Defendant’s Application Notice dated

                And

UPON the Court noting that the Claimant remains in breach of the Civil Procedure Rules Pre Action Protocol Practice Direction and CPR Rule 31.14.

                IT IS ORDERED THAT:

                1. The Claimant shall provide the Defendant a copy of the contract, a copy of the default notice, a copy of the assignment all referred to within the particulars of claim by 4pm on 2014 (28 days from the date of the order) If the Claimant breaches this paragraph then the Claimants claim shall stand struck out.
                2. Upon the Claimant complying with paragraph 1 the Defendant shall file and serve a Defence by 4pm on 2014. (28 days after compliance with para 1)
                3. The Claimant do pay the Defendant’s costs to be assessed if not agreed

                DATED. Day of 2014

Can I just do a final check that there needs to be no alteration or additions to this at all. I do not put one single date or change anything. I just submit it like this?

I'm doing my final Checks now before the court opens tomorrow and I can file this.

Is this draft order an Exhibit? What order should things go in? Is it Witness Statement (Exhibit 1), Draft Order (Exhibit 2) and then all the exhibits mentioned in the witness statement are the following exhibits? I'm trying to figure this out but I cant find any examples online to help me.

I noticed that there was a particular way to make a Witness statement look (thank you M1 for the link!) is there a way a Draft Order should look, is it the same kind of format at the Witness Statement?

Can I just reiterate how grateful I am for anyone who can answer me. But it goes without saying I specifically want to thank M1 for all the help recieved. You have been a great support and extremely helpful with all my silly questions.

You need to add in any dates you know such as the date of your application.

                    ---

As you can see this is troubling me the most! I guess its because I started using one draft order then changed to this new one, and the differences are really clear so I am unsure what is needed. Do that look right to add the names of the claimant and defendant to the top? Or is it not relevant to this particular draft order.

                    Should I lave a bigger space "
                    1. particulars of claim by 4pm on 2014 (28 days from the date of the order)" So the Judge has room to add the dates or again this this over thinking and not needed? THANK YOU SO MUCH!

The 2nd 27th isn't needed as that'll be the date the order is made by the judge

                        Thank you M1.

I think my only concern now is with exhibits. And what order they should be. Is the witness statement exhibit 1 and the draft order exhibit 2 and so on.

As long as they are numbered and in order it won't matter.

After sending the application to the Court do I have to inform BW Legal or send the documents to them? I understand that the court will send them copies but do I need to tell them I have done the application?

                              Thank you

No. You have already told them in the 31.14 letter and, one assumes, when asking where the hell are the documents.
