  • newly-discovered CCJ -- can I try and set it aside?

    Hi guys!
    I was hoping to ask for some advice regarding a CCJ. I moved abroad in January 2019 (by that point, the £100 I owed to Vodafone was already transferred to Ardent), updated my contact details, and agreed to keep in touch with Ardent. The case got sold to CCS Collect. I did the same rounds, updated the contact details, had a payment plan put in place and was waiting for a sign off.

    Without informing me they sold the case (three times), none of the companies got in touch (at least, not on the contact details given.) The CCJ was made in March 2020. I found out about it in January 2021. I've looked into setting it aside - do you think, what are my chances? Can I still reach out to the company with a consent form, or should I seriously consider paying the money and sobbing? Also, it transpires that the CCJ is for Vodafone and O2 combined -- though I've not received any comms from them.

    If you have kept them informed of your address then you should be able to get it overturned because they have used an incorrect address. Yes , that's the £255 but you can try and get this back.

    If this is from companies you've never had a contract with then this should be relatively easy.

    Acknowledge Claim - within 14 days from Service

    Defend Claim - within 28 days from Service (IF you acknowledged in time)

    If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
