    I lost an Employment tribunal for race discrimination about a year ago. Recently I read about racist microagressions.

    Throughout my ET my ex-employers witnesses used a number of such micro aggressions, such as mispronouncing my name and saying that they couldn't be racist as they had black friends (the usual rubbish).

    Anyway it has now dawned on me that the judge never once corrected or admonished them for their behaviour. Which in itself is racist (although he may not have realised this and was ignorant). Had the witness used the n or p words, then I'm sure he would have thrown them out of the hearing. But in this case he did not do anything.. therefore I believe I am a victim of a miscarriage of justice.

    My question to the forum is what can I do? Appeal? Complain to the Employment tribunal? Based on this could I get the case reheard on the basis I did not. Get a fair hearing?

    Also I was self represented and had no one to advise me at the time.

      Sorry that has happened, it is not right. Surprising an ET did not pick up on this. Other tribunals ignore it as it is entirely normal despite being wrong.

      Saying that, it is reasonable grounds but you normally have to bring the case within 6 months having taken an interest and read other cases #Metoo #BlackLivesMatter. That is not to say you cannot bring it now but it is a lot harder from what I have read and the best person to speak to would be an employment solicitor - a professional whom deals with this subject. https://solicitors.lawsociety.org.uk/

      Book yourself in with one. Spend 15minutes with them, and see where you stand.
