    Hello, thanks for taking the time to read my post and apologies in advance if I'm not posting it in the right place but I could just do with a little help checking something: as I understand it, if you reach a settlement through court-appointed mediators, while you are NOT allowed to discuss the specifics of either the process or eventual results of the mediation, you ARE allowed to discuss everything prior to that point? I.e. the specifics of the court claim that was filed which eventually lead to mediation?

    I am concerned about sharing information which would otherwise potentially prove useful to others on this forum.

    I've just seen your other post about this. If you've agreed a settlement with them and the settlement is contingent on you not disclosing any of the details about your claim/case then you can't say anything. I was involved in an employment dispute with a company who fired me for taking my paternity leave and got a large settlement but part of the agreement was that I couldn't disclose specifics about their behaviour before they fired me and during the mediation process. I'm guessing that as part of your complaint you've uncovered something that would put them in a bad light?

    With mine, I couldn't even discuss that I'd had a settlement. Any agreement you have would probably stipulate exactly what you can and can't say and the penalties if you break the agreement.

    Probably safer to say nothing.

      Is there a specific confidentiality clause within the settlement agreement or is it simply a mediation agreement ? Probably need the terms of the agreement to know exactly what you could and couldn't say.

        Acknowledge Claim - within 14 days from Service

        Defend Claim - within 28 days from Service (IF you acknowledged in time)

        If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
