I am looking for some advice as I have received a small claims form today.
I had a limited company with my colleague also as a director and 2 clients didn't pay their invoices 3 years ago and I had to cease trading. I sold everything in the company and paid the funds raised to the people the company owed money to. I then worked for months paying people back from work I was doing for people on a sole trader basis.
I got to the point where I was slipping into deep personal debt and struggling to feed my family and pay the house hold bills. I spoke to the people the company owed money to and explained I can't go on like this and they understood that I had done my best in the situation.
One contractor the company owed money to didn't understand which i understand my self. He would drop notes through my door, call my friends and family and text me at the weekends to say he is coming to speak to me and my wife who was not involved in the company. I would pay him some money to get him off of my back and I paid him £1200 of a £4000 invoice that was outstanding and as he kept harassing me at the start of the year I contacted the police and didn't hear from him again. He never contacted my business partner as I was seen as the soft touch.
Today out of the blue I received a claims form naming me and my ex business partner as defendants and the company name but without limited at the end.
Where do I stand ? The company was formed in 2012 and ceased trading 2014 before being dissolved a couple of months ago by companies house.
I am in no way proud of this situation and I did everything I could to try to prevent it from happening.
