  • Letter received- Cabot

    I started having huge problems with Cabot before Christmas, threatening me with arrest if I didnt come up with £350 in 3 days. I managed to by the skin of my teeth and the collecting baliff said that the courts would be in touch regarding a payment plan - I agreed with him to pay £100 a month and he said he'd pass that on and the courts would be in touch.
    By mid Jan I hadn't heard anything so I tried on a number of occaisions to contact the baliff as I hadnt heard anything from him or the courts but his phone was always off. I called Cabot and after they tried to fob me off with "you'll have to talk direct to the baliff" they realised they had forgotten to tell me he no longer worked for the company!!!!!! So, I was assigned another baliff who gets in touch and I pays him £100 from my card. Next day a different baliff contacts me demanding money! I called the bank and the money hasnt been taken. When I called the baliff he said he'd check it and get back to me - nothing! Cabot are criminals! The way i see it I shouldnt pay any more money, nothing is in writing and the service is appauling.
    Has anyone else had the same problem with Cabot? What should I do?
    Any advice much appreciated.

    Cabot are idiots, they are not baliffs tell them you are not paying any more than you can afford. Goodadvicewill be along soon.
    I am new to posting to this forum, but have a holiday problem hopesomeonw will help with.

      Try not to worry too much about these cowboys, they have very little power. Just ignore their threats and turn the tables on them.

      If you could give us more details on the so called debt owed. If you could give us a life story of the debt, what you have done?, what they have done?, how much? etc.
      The more details you can write down the better.

        Okay, Cabot are a load of charlatans who will try ANYTHING to get you to part with your money. As 'Phoenix' says you need to post up more details of the alleged debt before we can help you.
        But remember the first golden rule 'DON'T PANIC'. This can be solved, but you really need to give us all the details before any more advice can be given.

          To whom to you owe the money that Cabot are attempting to collect?

          Who told you that you would be arrested? You cannot be arrested for not paying your debts, although non-payment of council tax, child maintenance or magistrates court fines can lead to arrest and imprisonment if you "wilfully refuse" to pay.

          Do not confuse bailiffs with debt collectors - they are not the same thing.

          I appreciate that it is confusing and can be worrying, but do as the other posters have suggested and supply full details and you will get lots of help.

            Thanks for all the replys. I owe the money to Sainsburies. I got one of their card a couple of years ago and got into problems. It got worse until just before Christmas when Cabot got involved and got really heavy with me. It was the first bailif who told me I'd get arrested, which really scared me. They still havent taken the £100 payment. I'm glad to hear you say that you can't get arrested for debt. Do they always behave crminally? On the bright side, I'm going to visit my mum at the weekend and she was hinting that she might lend me the money to just pay the whole thing off. heres hoping.

              We need more info to advise you properly.
              1. Are Cabot collecting the debt for Sainsbury's, or have they bought it off them? If Cabot now own it they will have only paid a small amount for it and you will be able to negotiate a reduced sum if you clear it quickly.
              2. How much is still outstanding?
              3. Are there any penalty charges on the card?

                  And often considerably less. I have known of figures of 30% or less for a one-off payment.

                  I would not be in any hurry to borrow more, even from your Mum, to pay these people until you are absolutely certain what you owe, how much of that figure is the original debt and if they have added any penalty charges or penalty interest.

                    DON'T phone them. EVER. DON'T pay them a penny yet either.

                    Firstly, send them a request for a copy of the original agreement. It'll cost a pound as a statutory fee, which they will return as they will claim they are not obliged to provide this, but will be plased to help anyways.

                    If they CAN'T find a valid agreement, they CAN'T enforce the debt. They might try, but will fail. These people work safe in the knowledge that a very high percentage of people will pay up at the first threat. Don't let one of those suckers be you.
