I have received yet another letter from these people which has me wondering if they are breaking the law. They ask 'if a money advisor is dealing with the account, please call Cabot immediately with your advisor' s contact details. We'll be happy to speak to them directly about your account'.

Surely this can't be legal as I would have thought that permission to speak to a third party about a debt would need to be obtained first and there is no such mention of obtaining that permission in the letter.

Would welcome your opinion.

Oh, the poor dears don't have anyone they may harass by the electric telephone since you told them to stop pestering you. They've gone to the expense of setting up a call centre (or renting space in a call centre) but, with everyone wanting them to stop harassing alleged debtors, their (minimum wage) call centre drones have been getting bored.

Have they stopped calling you?

Yes, CC, they have stopped the calls since I treated them to 10 minutes of Jeremy Kyle a couple of weeks ago, but surely what they are suggesting can't be legal?

They are not breaking the law because they are not contacting any third parties by themselves. They are asking YOU if you are using a third party to manage your debts, such as a debt charity like Payplan/Stepchange or a commercial DMP provider. If so, YOU would be providing them with those details, which means you'd be autorising Cabot to contact them. This is normal when you are using the services of a DMP manager, they would deal with your creditors on your behalf.

Thanks for clearing that up for me Flaming Parrot. I hadn't looked at it from that point of view. I agree with what CC says and if I had found this site sooner I would have been spared a lot of worry. There are a lot of bullies out there.
