  • Cabot/Robinson Way

    Apologies for yet another post but today I received a letter from a firm of Debt Collectors called Robinson Way. The opening line of the letter says 'where have we gone wrong?' (do they really expect a serious answer to that?).

    They go on to say that they they are acting on behalf of their client, Cabot, who themselves have been trying repeatedly to contact me over the last couple of days. They also say that they may be in a position to offer a substantional discount on the debt.

    The letter is full of 'maybe's and possible's and I'm going to ignore it anyway but what is the relationship between Cabot and Robinson Way especially as until two days ago all was quiet.

    I would appreciate any comments.

    Robinson Way or Robbers Way :lol: are debt collectors, Cabot must have enlisted theirs services to act on their behalf.

    i remember seeing that opening paragraph somewhere, hilarious I'd say! :lol: :lol: Do post up if you get something more serious, Robbers Way are not normally amongst the most aggressive, however, Cabot like to litigate, do keep us posted. :thumb:

      No link that I know of. i.e. they are not part of the same company, group or share common ownership.

      Sounds like the normal contracting out between collectors that goes on all the time.

              Just a quick update: Cabot have been trying to call me over the last couple of days but I have not been answering. However when they called earlier I picked up the phone and when they asked me to go through security I turned up the TV and they had the pleasure of listening to Jeremy Kyle for the next few minutes.

              Please be assured that I do NOT usually watch that programme. Just thought I'd have a bit of fun at their expense.

                Well, they have just rung for the fifth time today today so I decided to play them at their own game. When they wanted me to go through security I declined to do so unless the operator told me her security details as well before I would even consider it. This went down like a lead balloon needless to say. She then said that she would accept part of my details. I asked her which charm school she had attended and put the phone down.

                Sarcasm aside, I'd like to know how many calls a day constitute harassment and whether accepting only partial security answers to questions is breaking the law in some way?

                  If you are feeling harassed, write one letter asking them to stop the calls and put everything in writing for the avoidance of doubt. Once they have received that, any phone calls are harassment in my book. It's impossible to put a number on, but when it becomes an intrusion into your life, it is harassment.

                  If you want a letter asking them to stop telephone harassment, there is a series of letters that can be sent, getting more and more serious. Just ask!

                    You could send them a letter stating you will only communicate in writing, such as the one below. May be a good idea to log all the calls you receive from them as well. :thumb:

                    Dear Sirs

                    Reference No: xyz

                    I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing. I now require all further correspondence from your company to be made in writing only. I am of the view that your continued harassment of me by telephone puts you in breach of the Protection from Harassment Act 1997 as well as Section 40 of the Administration of Justice Act 1970.

                    I ought to draw your attention to the recent Harrison v Link Financial case in which HH Judge Chambers outlined the predatory way in which the account holder was hounded; I quote, from this judgment;

                    "Cumulatively and damningly is what I find to be the way that MBNA and the Defendant went about recovering their debt. I am satisfied that the Claimant’s description of the way that he was hounded by his creditors is essentially correct not least in the use of “non-traceable” telephone calls. It seems to me that such conduct has no proper function in the recovery of consumer debt"

                    If you continue to harass me by telephone, you will also be in breach of s.127 of the Communications Act (2003) and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you may be liable to a substantial fine and/or other sanctions as they see fit. Be advised that any further telephone calls from your company may be recorded and used in evidence and I expect this harassment to cease immediately.
